Former President Yoon Suk-yeol, who has been re-arrested, reported on the 16th that he has filed a petition challenging the legality of his detention.
Yoon's legal representatives stated in a notice sent to reporters that "this morning, we filed a petition for the review of Yoon's detention with the Seoul Central District Court," adding, "We plan to contest the general legal principles of detention, arguing that it is substantively and procedurally illegal and unjust."
The detention review is a procedure in which the legality of a suspect's detention and the necessity of continuing the detention are examined and judged by the court. The court assigns the case to a designated panel, which must conduct the suspect's interrogation and evidence investigation within 48 hours of the petition being filed. Subsequently, the court will assess the necessity for detention by considering the requirements and any procedural violations, as well as the concern of evidence destruction or flight risk before deciding on release. During this period, the special investigation into Yoon will be suspended.
Earlier, on the 10th, Yoon was re-arrested on charges of obstructing official duties and abuse of power and is currently at the Seoul Detention Center. Director General Nam Se-jin of the Seoul Central District Court issued a detention warrant for Yoon around 2 a.m. that same day, citing a "risk of evidence destruction" as the reason.
