According to the legal community on the 16th, former President Yoon's review of the legality of his arrest will take place at 10:30 a.m. on the 18th in the 9th Criminal Division of the Seoul Central District Court, presided over by Directors General Ryu Chang-seong, Jung Hye-won, and Choi Bo-won.
On that morning, former President Yoon's legal team announced that they had requested a review of the legality of the arrest. The legal team stated, "We will clarify specifically in court the unlawfulness and injustice of the arrest."
The review of the legality of the arrest is a procedure in which the court examines and determines the legality of the suspect's detention and the necessity to continue the detention. The court will assign the case to a presiding judge, who must conduct the suspect's examination and gather evidence within 48 hours of the request. After that, the court will decide whether to release the suspect by examining the legal requirements and procedural violations, concerns about evidence destruction, or the possibility of flight. During this period, the special investigation into former President Yoon will be suspended.
