The court ruled that the producers of the documentary film denying the sexual assault case against the late former Seoul Mayor Park Won-soon must compensate the victim with 10 million won.
According to the legal community on the 14th, the Seoul Southern District Court's Civil Division 15 (Director General Yoon Chan-young) issued a partial victory ruling for the plaintiffs in the damage lawsuit filed by the victim's side against the documentary production committee 'People Who Trust Park Won-soon' and Director Kim Dae-hyun on the 3rd.
The court determined that the production committee and Director Kim were responsible for compensating the victim with 10 million won.
The court also restricted the screening or distribution of 'First Argument' and stated that in case of violation, the defendants must pay the victim 20 million won for each violation.
'First Argument' is a film based on the book 'The Birth of a Tragedy' by Oh My News reporter Son Byeong-gwan, which deals with the sexual harassment case involving the former mayor. It received criticism for committing secondary harm by claiming that the victim lacked 'victimhood.'
The court noted, "The defendants' claims are merely citing some of the plaintiffs' fragmented statements and actions," adding that it contains content that seriously undermines the plaintiffs' social evaluation and significantly infringes upon their personal rights.
