A court decided that if the YouTube channel 'Garosero Research Institute' posts videos related to the YouTuber Tzuyang (real name Park Jeong-won), it will incur an indirect fine of 10 million won per case.
According to the legal community, on the 26th, the Seoul High Court's Civil Division 25-2 (Chief Judge Hwang Byeong-ha, Jeong Jong-kwan, Lee Gyun-yong) accepted an appeal regarding the partial acceptance decision for a request for the deletion of posts and a ban on publication filed by Tzuyang against Gaseyeon and its representative Kim Se-eui.
The court stated, "We must ensure the effectiveness of the original decision and prevent the creditor's honor and privacy from being continuously violated," and added, "If the debtors conduct live broadcasts or produce videos or posts for their YouTube channel, it is necessary to order them to pay an indirect fine of 10 million won for each violation. "
Earlier, the Seoul Central District Court's Civil Division 51 (Chief Judge Park Sang-eon) partially accepted Tzuyang's request for video deletion in April, ordering Gaseyeon to delete some videos. However, it stated that any request for indirect enforcement related to video deletion should be made separately if necessary. Tzuyang immediately appealed.
The controversy began when YouTuber Kim Se-eui addressed allegations regarding Tzuyang's involvement in the entertainment industry during a broadcast in July of last year. He claimed Tzuyang was blackmailed based on the fact that she had previously worked in such establishments, and used recorded conversations she shared in the broadcast. He continued to cover the related content persistently.
Tzuyang clarified that she was forced to work in the entertainment industry due to violence and coercion by a former partner, and filed a lawsuit against Kim Se-eui for violations of the stalking punishment law, threats, and coercion.
