On the same day, special prosecutor Cho Eun-seok stated in a notice sent to reporters, "The military prosecution has added charges against former counterintelligence commander Lee In-hyung for perjury and former intelligence commander Moon Sang-ho for leaking military secrets and violating the Personal Information Protection Act, and has requested the issuance of additional arrest warrants."

Former commander Lee faces allegations of perjury related to the military's intrusion into the election commission during the martial law period at the Constitutional Court and military court. Former commander Moon is charged with leaking personal information related to the investigation into the election commission's involvement in election fraud after the declaration of martial law on Dec. 3, in connection with the formation of a so-called 'second investigation team.'

Additionally, the military prosecution announced it is requesting the court to issue additional arrest warrants for these individuals and has withdrawn its previous request for conditional release.

Previously, former commander Lee was arrested and indicted in December last year for forming and operating a detainment unit upon the orders of former Minister of National Defense Kim Yong-hyun to arrest and detain around 10 people, including National Assembly Speaker Woo Won-sik, during the martial law on Dec. 3. Former commander Moon was arrested and indicted in January for allegedly conspiring with former President Yoon Suk-yeol, former Minister of National Defense Kim Yong-hyun, and former intelligence commander Roh Sang-won regarding the martial law.

Former commander Lee faces the expiration of the first trial detention period on July 3, while former commander Moon's detention period expires on July 5. Under criminal procedure law, the maximum detention period in the first trial is six months. If the detention period is completed and they are released, they will be able to undergo the trial without any special restrictions.
