The criminal retrial of Kim Jae-kyu, the former director of the Central Intelligence Agency, who was executed in 1980 for the '10·26 incident', will be held.
According to the legal community on the 13th, the Supreme Court's 1st Division, headed by Justice Shin Sook-hee, confirmed the decision of the lower court to accept the retrial request from Kim Jae-kyu's relatives and dismissed the prosecution's appeal.
Earlier, the Seoul High Court, which examined whether to initiate the retrial, stated, "It can be acknowledged that investigators belonging to the martial law command's joint investigation team committed assault and abuse," and decided to commence the retrial.
Although the prosecution objected, the Supreme Court deemed the Seoul High Court's judgment appropriate and dismissed the prosecution's appeal.
It has been 45 years since he was sentenced to death in 1980, and if the retrial result finds the court acknowledges insufficient evidence to prove the charges, a not guilty verdict will be issued.
Meanwhile, Kim Jae-kyu was indicted for the murder of former President Park Chung-hee and former Blue House Security Chief Cha Ji-cheol on October 26, 1979, and was executed in May of the following year, six months later.
