According to the Seoul Southern District Court, Kim's side submitted a written withdrawal of the provisional injunction to suspend the effect of the presidential candidate cancellation to the court on that day.

Earlier, Kim's side filed a provisional injunction with the Seoul Southern District Court on the morning of the same day, stating, "Suspend the effect of the presidential candidate cancellation," when the People Power Party leadership urgently held a meeting of the emergency response committee and the election management committee on the morning of the 10th, pushing for a change of presidential candidate.

The Civil Division 51 of the Seoul Southern District Court (Chief Judge Kwon Sung-soo) held an immediate hearing that afternoon. However, as the party leadership conducted a public opinion poll about changing the presidential candidate to Han Duck-soo, who is a preliminary candidate for all party members, the result showed that there were more opposing opinions than supportive ones, leading to the rejection. Consequently, Kim regained his status as a candidate.

Meanwhile, Kim completed the registration as a candidate for the 21st presidential election at the National Election Commission in Gwacheon, Gyeonggi Province, that morning. Kim issued a statement that day, saying, "As the candidate's status and powers were restored following the results of the party member vote yesterday, there is no practical benefit to the provisional injunction, so I withdrew the application for provisional injunction at 9:30 a.m. today."
