On the same day, Shim sent a statement to the Supreme Public Prosecutors' Office press corps, stating, "(The Democratic Party's push for the impeachment of the Prosecutor General) is an attempt to impeach the Prosecutor General who is responsible for investigating election-related crimes and public welfare crimes nationwide, undermining fair elections and the rule of law."

That day, after the Supreme Court overturned the ruling regarding the election law violation case of Democratic Party presidential candidate Lee Jae-myung with a guilty opinion, the Democratic Party introduced a motion for impeachment against Shim. All 170 members of the Democratic Party were listed as supporters of the impeachment motion.

The Democratic Party stated as grounds for impeachment that "Shim engaged in President Yoon Seok-youl's declaration of a state of emergency and the armed uprising." It also noted that "It caused unnecessary extensions of detention periods against a president who engaged in insurrection, leading to the court's decision to cancel the detention."

According to the National Assembly Act, the impeachment motion can be voted on within 24 hours after being reported to the plenary session or referred to the Judiciary Committee for investigation within 72 hours.
