The Seoul High Court partially accepted a request from food broadcaster Tzuyang for a provisional injunction.
According to the legal community on the 26th, the 25-2 Civil Division of the Seoul High Court (Director General Hwang Byung-ha, Jeong Jong-kwan, Lee Kyu-yong) made a partial acceptance decision on the 24th regarding the appeal filed by Tzuyang (real name Park Jeong-won) against the YouTube channel Garosero Research Institute (abbreviated Gaseyeon) and its representative Kim Se-eui, seeking a ‘deletion of video posts and a prohibition on posting’ related to the provisional injunction application.
The court stated, “If Gaseyeon and Kim Se-eui post videos related to Tzuyang, they must pay 10 million won each time to Tzuyang,” and ordered the payment of indirect coercive penalties.
It pointed out, “The debtors posted videos with the purpose of expanding and reproducing related allegations even after the original decision. There seems to be a high likelihood that they will repeatedly post videos in violation of the first-instance decision in the future without a separate indirect coercive decision.”
Previously, the Seoul Central District Court’s Civil Division 51 (Director General Park Sang-eon) had partially accepted the provisional injunction request, ordering some videos requested for deletion by Tzuyang to be removed due to elements infringing on personality rights or privacy.
However, regarding the application for indirect coercion to incur costs in case of violations, the court dismissed it, stating, “A separate application for indirect coercive measures can be made in case of circumstances arising.” Consequently, Tzuyang immediately appealed, and part of the appeal was accepted in the second instance.
Meanwhile, Gaseyeon revealed that Tzuyang was threatened by YouTuber Gujae-rok in July of last year, releasing related transcripts, asserting that Tzuyang was threatened by having her past employment at an entertainment establishment brought up.
In response, Tzuyang revealed that she worked at an entertainment establishment due to violence and coercion from her ex-boyfriend, but Gaseyeon continued broadcasts stating that her explanation was ‘not true.’ Eventually, Tzuyang filed a complaint against Mr. Kim for violations of the Stalking Punishment Act and for threats and coercion.
