According to the legal community in December last year, the Supreme Court's second division (Chief Justice Kim Sang-hwan) overturned the lower court's ruling that sentenced broadcast writer A to 9 years in prison and ordered the confiscation of over 2.6 billion won for violations of the Act on the Aggravated Punishment of Specific Economic Crimes (Fraud) and the Lawyer Act, sending the case back to the Seoul High Court.
A is suspected of deceiving Lee Min-woo into receiving 1.6 billion won by claiming, despite having no connections with prosecutors, that he could ensure a no-charge decision due to having connections within the prosecution when he was implicated in the sexual assault of two women in June 2019. Over the course of 26 months, he is accused of embezzling a total of 2.6 billion won. Furthermore, in December of the same year, after Lee Min-woo was cleared of charges, he reportedly approached him again, demanding more money by stating, "The dismissal of charges must not be disclosed before the necessary 10 days for closing the case, and you have caused delays by not stopping media reports."
After the first and second trials judged A's charges as guilty, sentencing him to 9 years in prison and confiscating 2.636 billion won, the Supreme Court directed that the case be re-examined, stating, "It misunderstood the legal principles concerning unlawful actions post-fact." The Supreme Court noted, "The lower court should have further examined whether the transferred funds in question were a separate sum from the loan in this case and whether the defendant's actions caused increased harm or new legal infringements to the victim."
In particular, Lee Min-woo revealed that he developed facial paralysis symptoms due to stress this March. He said, "In order to completely cure guan waza, treatment must begin within 72 hours of the initial symptoms in the golden time. If left untreated for years like me, a complete cure may be difficult, but it can get better with consistent treatment," which evoked sympathy.
