The group NewJeans has been ordered by a court to pay 1 billion won in damages to its agency if they operate independently without ADOR. This follows a preliminary injunction decision.
According to the legal community on the 30th, the Seoul Central District Court's Civil Division 52 (Director General Heo Kyung-moo) accepted the indirect compulsory execution request filed by ADOR against NewJeans the day before. Indirect compulsory execution is a measure that orders compensation for a certain amount based on the delayed period if a court decision is not implemented.
The court noted, "Until the first instance ruling of the validity of the exclusive contract is announced, you must not engage in entertainment activities without prior approval or consent from ADOR," and instructed, "If this is violated, pay 1 billion won to ADOR for each violation."
According to the court's acceptance of the indirect compulsory execution request, NewJeans must pay 1 billion won to ADOR for each violation if they continue their entertainment activities independently without prior approval or consent from ADOR. Since it is 1 billion won for each violation, if NewJeans continues independent activities, they will end up paying a total of 5 billion won to ADOR.
Previously, on March 21, the Seoul Central District Court's Civil Division 50 (Director General Kim Sang-hoon) accepted the injunction filed by ADOR, ruling that NewJeans should not engage in independent activities.
According to the court's ruling stating that "you must not engage in entertainment activities independently (including through legal representatives or third parties) without prior approval or consent from ADOR," the NewJeans members have been prevented from using their new name 'NJZ' as well as from performing independently.
As a result, NewJeans announced the cessation of all activities, concluding with a performance at the Hong Kong ComplexCon scheduled for the 23rd of the same month. Members expressed, "It weighs heavy on my heart to convey this. Today's stage may be our last performance for a while. We have decided to stop all activities out of respect for the court's decision."
However, it is reported that NewJeans did not meet with ADOR staff who traveled to Hong Kong on the day to support ComplexCon. Even after the injunction was accepted, as NewJeans proceeded with ComplexCon without ADOR, it appears that ADOR applied for indirect compulsory execution to enforce the court's decision. As a result, NewJeans will have to compensate 1 billion won per person if they engage in independent activities without ADOR.
