Singer Yoo Seung-jun's third administrative lawsuit against the government has been postponed to June.
According to a report by a media outlet on the 8th, the Seoul Administrative Court's Administrative Division 5 was scheduled to hold the second hearing for Yoo Seung-jun's lawsuit against the Consulate General in Los Angeles and the Ministry of Justice regarding the cancellation of the visa issuance refusal and the confirmation of the non-existence of the entry ban on the afternoon of that day, but it has been postponed to June 26.
The specific reason for the postponement has not been disclosed.
The administrative lawsuit filed by Yoo Seung-jun against the government is already the third one since 2015.
Previously, Yoo Seung-jun underwent a physical examination to enlist in the military in 2001, but he obtained U.S. citizenship in January 2002 and renounced his Korean nationality, resulting in an exemption from military service and an entry ban. In response, he filed a lawsuit against the Consul General in LA in 2015 to cancel the visa issuance refusal, and after five years of trial, he won a ruling from the Supreme Court in March 2020. However, the Ministry of Foreign Affairs noted that "the essence of the Supreme Court's ruling indicates that there were procedural issues in the visa issuance refusal process," and again denied Yoo Seung-jun's visa application. Yoo Seung-jun subsequently filed another administrative lawsuit against the Consul General in LA in October 2020.
The first trial court dismissed Yoo Seung-jun's claim, stating that the essence of the Supreme Court ruling indicated 'there are procedural violations in the visa issuance refusal,' not that 'Yoo Seung-jun should be issued a visa.' After this ruling was made in April 2022, Yoo Seung-jun appealed. The court overturned the first trial ruling. Following his victory in the appellate trial, Yoo Seung-jun increased his chances of returning to his homeland, but the consulate also filed a petition to appeal. Subsequently, the Supreme Court's Division 3 confirmed the original ruling in favor of the plaintiffs by dismissing it without examination.
However, last year, the Consulate General in LA sent a notification rejecting Yoo Seung-jun's visa application, stating, "The Ministry of Justice has decided to maintain the entry ban on Mr. Yoo Seung-jun. The activities of Mr. Yoo Seung-jun since July 2, 2020, could harm the national security, order maintenance, public welfare, and diplomatic relations of the Republic of Korea, leading to the decision to again refuse the visa issuance to Mr. Yoo Seung-jun."
Ultimately, Yoo Seung-jun filed his third administrative lawsuit against the government in September last year. In this regard, Yoo Seung-jun noted on his social media, "Everyone should be equal before the law. Is that really the case? Am I really exhausted? I wanted to give up countless times, but I couldn't because I loved it. This has been going on for 23 years."
